AN ACT relating to motor vehicles; repealing the provisions relating to the disclosure of the odometer reading of a motor vehicle when the ownership of that motor vehicle is transferred; requiring the department of motor vehicles and public safety to enforce the provisions of the federal law relating to the disclosure of the odometer reading of a motor vehicle and certain other information when the ownership of that motor vehicle is transferred; and providing other matters properly relating thereto. THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 484 of NRS is hereby amended by adding thereto a new section to read as follows: \The department shall enforce the provisions of 49 U.S.C. §§ 32701 et seq. and the regulations adopted pursuant thereto. \\Sec. 2. NRS 484.606 is hereby amended to read as follows: 484.606 As used in NRS 484.606 to 484.6069, inclusive, \and section 1 of this act,\\ unless the context otherwise requires: 1. "Odometer" means an instrument for measuring and recording the total distance which a motor vehicle travels while in operation\ .\\ [; but]\ The term\\ does not include any auxiliary odometer designed to be reset by the operator of the motor vehicle. 2. "Repair and replacement" means restoration to a sound working condition by replacing the odometer or any part thereof, or by correcting what is inoperative. 3. "Transfer" means to change ownership by purchase, gift or any other means. Sec. 3. NRS 484.6066 is hereby repealed. "T T" TEXT OF REPEALED SECTION "T T" 484.6066 Statement of mileage required on transfer of vehicle; exemption; transferee to retain statement. 1. Upon the sale or transfer of a motor vehicle, the transferor shall furnish the transferee with a written statement containing: (a) The odometer reading at the date of transfer; (b) The current address of the person making the sale or transfer; and (c) The identity of the vehicle, including the make, model, body type, vehicle identification number and the vehicle registration number. 2. If the transferor has knowledge or reason to believe that: (a) The odometer reading differs from the actual mileage, he shall include a statement of the actual mileage or a statement that the actual mileage is unknown. (b) The odometer has been turned back or replaced, he shall so notify the transferee before any sale, and obtain the transferee's signed acknowledgment of this notification. 3. If the vehicle being transferred is a bus or truck which weighs over 16,000 pounds and is accompanied by maintenance records, the department may exempt such vehicle, by regulations, from the provisions of NRS 484.606 to 484.6069, inclusive. 4. The transferee shall retain the statement in his possession for not less than 2 years. -30-
